Terms of Use

Welcome to Ritual. These Terms of Use ("Terms") are an agreement between you and Bekker Labs Pty Ltd (ACN 699 280 012, ABN 79 699 280 012) ("Bekker Labs," "we," "us," "our"). They govern your access to and use of the Ritual mobile application, website, NFC tiles, and associated services (collectively, the "Service"), which are operated and provided by Bekker Labs.

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Ritual is available in Australia, New Zealand, the United States, and South Africa. It is not offered in the European Union or the United Kingdom.

1. Eligibility

You must be at least 18 years of age (or the age of majority where you live, if higher) to create a family account on Ritual. Children may use the Service under the supervision of a parent or guardian who has created and manages the family account. The parent or guardian is responsible for all activity under their family account, including the use of the Service by children.

2. Account and Security

When you create a family account, you are responsible for maintaining the confidentiality of your sign-in details and family PIN and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use of your account. The information you give us when you sign up must be accurate.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or in a manner that could harm the Service or other users.

3. Information About Your Children

Ritual lets you add profiles for the members of your household, including children. By adding a profile for a child, you confirm that you are that child's parent or guardian, or that you are otherwise entitled to share their information, and you authorise us to process it to provide the Service. We handle children's information as described in our Privacy Policy, including its dedicated children's section.

4. Pricing

Ritual is currently provided free of charge. We intend to introduce paid plans in the future. Before any charge applies to you, we will update these Terms, and pricing and billing terms will be presented to you in the app; any payments would be processed by Apple through the App Store, not by us directly.

You agree to use the Service only for its intended purpose — tracking personal and family habits. You agree not to:

6. NFC Tiles

Ritual may provide or sell NFC tiles designed to work with the Service. These tiles are passive NFC tags that contain a URL or identifier to trigger actions within the app.

Intended use: NFC tiles are intended for use exclusively with the Ritual app for the purpose of habit tracking. They should be used in accordance with any instructions provided.

No data stored on tiles: No personal data is stored on the physical NFC tiles. Each tile contains only a unique identifier and/or URL.

Tile safety: NFC tiles are passive electronic tags that do not contain batteries, emit radiation, or pose known safety hazards under normal use. However, they should be kept away from small children who may present a choking risk, and should not be modified, disassembled, or exposed to extreme heat or moisture.

Third-party NFC readers: Ritual NFC tiles may be readable by third-party NFC-enabled devices. The information readable from a tile is limited to its unique identifier and/or a URL. We are not responsible for how third-party devices or applications interpret or process this information.

7. Deleting Your Account and Data

You can remove any family member's profile from within the app at any time — this permanently deletes that profile and its habit completion history. You can also delete individual habits and rewards in the app.

To delete your entire family account and all associated data, email us at hello@ritualhabits.com.au. We action verified deletion requests within 30 days, as described in our Privacy Policy.

8. Intellectual Property

The Service, including its design, code, features, content, and branding, is owned by us and is protected by Australian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

You retain ownership of any content you create within the Service (such as custom habit names and descriptions). By using the Service, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, and process that content solely for the purpose of providing and improving the Service. We don't sell your content and we don't use it to train any AI model.

9. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Service and any associated NFC tiles are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any data will be secure or not lost. We do not warrant that the NFC tiles will function with all devices or under all conditions.

Australian Consumer Law notice: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms purports to modify or exclude the conditions, warranties, and undertakings implied by the Competition and Consumer Act 2010 (Cth) or any similar state or territory legislation. For major failures with the Service, you are entitled to a replacement or refund. For major failures with NFC tiles, you are entitled to a replacement or refund. You are also entitled to compensation for any other reasonably foreseeable loss or damage.

10. Limitation of Liability

To the maximum extent permitted by applicable law and subject to the Australian Consumer Law guarantees described above, in no event shall we be liable for any:

To the extent permitted by law, our total aggregate liability to you for all claims arising from or related to the Service or NFC tiles shall not exceed the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or AUD $50, whichever is greater.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will use reasonable efforts to provide advance notice of material changes. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

13. Changes to These Terms

We may update these Terms as Ritual changes or as the law changes. If we make a material change, we'll update the "Last updated" date above and tell you in the app or on our website before the change takes effect for you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, please stop using the Service.

14. Termination

You may stop using the Service and request deletion of your account at any time (Section 7). We may terminate or suspend your access to the Service at our discretion if you breach these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property, limitation of liability, indemnification, and governing law.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia, and you and we submit to the jurisdiction of the courts of Victoria — except where the law of the country you live in gives you mandatory rights or a right to bring proceedings locally, which these Terms do not override.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements or understandings.
